Terms of Service

These Terms of Service govern your access to and use of Pulse, including our mobile application, website, services, features, groups, prediction markets, virtual credits, content, and related services.

Pulse is operated by Atlas Studios LLC doing business as Pulse. In these Terms, “Pulse,” “we,” “us,” and “our” refer to Atlas Studios LLC and its affiliates, operators, employees, agents, and service providers. “You” and “your” refer to the person using Pulse.

By creating an account, accessing Pulse, joining a group, creating a market, placing a prediction, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use Pulse.

1. What Pulse Is

Pulse is a social entertainment app that lets private groups create and participate in prediction markets about events, plans, games, personal challenges, group debates, and other outcomes.

Pulse is designed for casual, social use among friends, families, classmates, teams, and private communities. Pulse is not a gambling platform, sportsbook, casino, securities exchange, commodities exchange, financial marketplace, investment platform, or broker-dealer.

Pulse may allow users to make predictions using virtual credits. Virtual credits are for entertainment and in-app tracking only. They have no cash value and cannot be redeemed, exchanged, sold, transferred for money, withdrawn, or converted into prizes or anything of monetary value.

2. Eligibility

You must be at least 13 years old to use Pulse.

If you are under the age of majority in your state or country, you may use Pulse only with permission from a parent or legal guardian. By using Pulse, you represent that you meet these requirements.

You may not use Pulse if:

  1. You are under 13 years old.
  2. You have been suspended or banned from Pulse.
  3. Your use of Pulse would violate any law, regulation, court order, or these Terms.
  4. You are using Pulse for gambling, illegal betting, financial trading, regulated event contracts, fraud, harassment, or other prohibited activity.

3. Accounts

To use certain features, you may need to create an account. You agree to provide accurate information and keep your account information up to date.

You are responsible for maintaining the security of your account, device, login credentials, and any activity under your account. You must notify us promptly if you believe your account has been accessed without permission.

You may not sell, transfer, share, or assign your account to another person.

4. Private Groups

Pulse may allow users to create, join, manage, or participate in private groups. Group creators or admins may have controls such as inviting members, removing members, creating markets, resolving markets, or moderating content.

Group admins are responsible for using these controls fairly and lawfully. Pulse may override, remove, suspend, or modify any group, market, resolution, or user action if we believe it violates these Terms, creates legal risk, harms users, or undermines the integrity of the Service.

Private groups are not guaranteed to be fully private. Other group members may view, screenshot, copy, share, or disclose content you post. Do not post anything you would not want other group members to see or save.

5. Prediction Markets

Pulse allows users to create prediction markets or participate in markets created by others. A market may ask users to predict whether something will happen, who will win, what outcome will occur, or another event-based question.

When creating a market, you agree to make the market clear, lawful, and resolvable. You should include:

  1. The exact outcome being predicted.
  2. The deadline for predictions.
  3. The source or method used to resolve the outcome.
  4. Any special rules or conditions.
  5. The person or admin responsible for resolving the market.

Pulse may remove, edit, freeze, void, or reverse any market or resolution if we believe the market is unclear, abusive, unlawful, manipulated, impossible to resolve, or inconsistent with these Terms.

6. Market Resolution

Markets may be resolved by the market creator, a group admin, community vote, automated data, or another method made available in the app.

Pulse does not guarantee that every market will be resolved correctly, fairly, quickly, or without dispute. Users are responsible for reviewing the market terms before participating.

Pulse may, but is not required to, intervene in disputes. Our decision on any disputed market, credit adjustment, account action, or moderation issue is final.

7. Virtual Credits

Pulse may provide virtual credits, points, tokens, balances, scores, or similar in-app units.

Virtual credits:

  1. Are for entertainment and app functionality only.
  2. Have no cash value.
  3. Are not money, currency, property, securities, commodities, or financial instruments.
  4. Cannot be redeemed for cash, prizes, gift cards, goods, services, or anything of value.
  5. Cannot be sold, transferred, traded, exchanged, withdrawn, or cashed out.
  6. May be modified, reset, removed, expired, limited, or discontinued by Pulse at any time.
  7. Do not create ownership rights.

You do not own virtual credits. You receive a limited, revocable permission to use them within Pulse, subject to these Terms.

Pulse may adjust credit balances to correct errors, prevent abuse, resolve disputes, enforce these Terms, or protect the Service.

8. No Gambling, Betting, or Cash-Outs

Pulse is not intended for gambling, betting, wagering, contests of chance, lotteries, sweepstakes, paid prize competitions, financial speculation, or real-money prediction markets.

You may not use Pulse to:

  1. Bet real money.
  2. Offer or accept real-money stakes.
  3. Use Pulse credits as a substitute for money.
  4. Exchange Pulse credits for cash, prizes, goods, services, or anything of value.
  5. Coordinate off-platform payments based on Pulse market outcomes.
  6. Create markets that operate as gambling, sports betting, political betting, financial trading, or regulated event contracts.
  7. Use Pulse to evade gambling, securities, commodities, tax, consumer protection, or financial laws.

If we believe a market or group is being used for prohibited wagering or real-money activity, we may remove the market, suspend the group, terminate accounts, reset credits, preserve records, and cooperate with legal authorities where appropriate.

9. Prohibited Markets

You may not create, participate in, promote, or encourage markets involving:

  1. Illegal activity.
  2. Real-money betting, gambling, or wagering.
  3. Cash prizes, gift cards, valuable rewards, or off-platform payouts.
  4. Death, injury, self-harm, suicide, violence, terrorism, or abuse.
  5. Harassment, bullying, humiliation, stalking, doxxing, or targeted abuse.
  6. Sexual content involving minors or exploitation of any person.
  7. Hate, discrimination, or dehumanizing content.
  8. Private personal information, including someone’s location, health status, finances, sexuality, relationships, or family matters without consent.
  9. Academic cheating, employment misconduct, fraud, or evasion of rules.
  10. Manipulation of app stores, reviews, votes, contests, or public platforms.
  11. Securities, commodities, crypto, derivatives, sports betting, elections, or other regulated markets, unless expressly allowed by Pulse in writing and legally permitted.
  12. Anything that incentivizes harmful, unsafe, deceptive, or unlawful behavior.

Pulse may remove any market at our discretion.

10. User Content

You may create, upload, submit, post, send, or display content through Pulse, including usernames, profile information, group names, market questions, market descriptions, comments, messages, images, votes, predictions, and other materials.

You retain ownership of content you create, subject to the license below.

By posting content on Pulse, you grant Pulse a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, use, reproduce, modify, display, distribute, publish, transmit, and process your content as needed to operate, improve, promote, protect, and provide the Service.

You represent that you have all rights necessary to post your content and that your content does not violate these Terms, any law, or the rights of another person.

11. Content Standards

You agree not to post content that is:

  1. Illegal, fraudulent, deceptive, or misleading.
  2. Harassing, abusive, threatening, or bullying.
  3. Hateful, discriminatory, or violent.
  4. Sexually exploitative or involving minors.
  5. Invasive of privacy or publicity rights.
  6. Infringing of intellectual property rights.
  7. Spam, scams, phishing, malware, or manipulative activity.
  8. Designed to interfere with Pulse or other users.
  9. Otherwise objectionable or harmful in Pulse’s discretion.

Pulse may moderate, remove, restrict, or report content at any time.

12. Acceptable Use

You agree not to:

  1. Use Pulse for illegal, harmful, deceptive, or abusive purposes.
  2. Harass, threaten, impersonate, or defraud others.
  3. Manipulate markets, outcomes, votes, credit balances, referrals, leaderboards, or app systems.
  4. Use bots, scripts, scrapers, automation, or unauthorized APIs.
  5. Reverse engineer, copy, modify, or interfere with the Service.
  6. Attempt to access accounts, systems, data, or groups without authorization.
  7. Upload malware or harmful code.
  8. Circumvent suspensions, bans, limits, or security features.
  9. Misrepresent your identity or affiliation.
  10. Use Pulse in a way that creates legal, regulatory, reputational, or safety risk for Pulse or others.

13. Reporting and Moderation

Users may be able to report markets, groups, messages, profiles, or other content. Pulse may review reports and take action at our discretion.

Moderation actions may include warnings, content removal, market voiding, group restrictions, credit adjustments, account suspension, account termination, or legal reporting.

Pulse is not obligated to monitor all content or resolve all disputes. However, we reserve the right to do so.

14. Safety and Emergency Disclaimer

Pulse is not an emergency service. Do not use Pulse to report emergencies, threats, self-harm, violence, medical emergencies, crimes in progress, or urgent safety issues. Contact local emergency services immediately.

If we become aware of content suggesting imminent harm, we may take action, including contacting law enforcement or emergency responders.

15. App Store Terms

If you download Pulse through the Apple App Store, Google Play Store, or another app marketplace, your use may also be governed by that marketplace’s terms, rules, and policies.

Those platforms are not responsible for Pulse’s content, services, virtual credits, markets, support, or claims, except as required by their own terms or applicable law.

16. Third-Party Services

Pulse may use third-party providers for hosting, analytics, authentication, notifications, payments, moderation, customer support, crash reporting, communications, and other functions.

We are not responsible for third-party services, websites, software, content, or policies. Your use of third-party services may be subject to their own terms and privacy policies.

17. Intellectual Property

Pulse, including its name, logo, design, software, interface, graphics, features, code, content, and trademarks, is owned by Atlas Studios LLC or its licensors.

You may not copy, modify, distribute, sell, lease, reverse engineer, scrape, or create derivative works from Pulse except as allowed by law or expressly permitted by us in writing.

18. Feedback

If you send us feedback, ideas, suggestions, designs, feature requests, or improvements, you grant us the right to use them without restriction or compensation to you.

19. Beta Features

Pulse may offer experimental, beta, or early-access features. These features may be incomplete, unstable, inaccurate, unavailable, or discontinued at any time. We may modify or remove beta features without notice.

20. Availability and Changes

We may update, suspend, limit, discontinue, or modify Pulse or any part of it at any time. We do not guarantee that Pulse will always be available, secure, error-free, or uninterrupted.

We may also update these Terms from time to time. If we make material changes, we may notify you through the app, email, or other reasonable means. Your continued use of Pulse after changes become effective means you accept the updated Terms.

21. Termination

You may stop using Pulse at any time. You may also request account deletion through the app or by contacting us.

We may suspend or terminate your account, groups, markets, credits, or access to Pulse at any time if we believe you violated these Terms, created risk, misused the Service, or harmed other users.

Upon termination, your right to use Pulse ends immediately. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnity, dispute resolution, and governing law.

22. Disclaimers

Pulse is provided “as is” and “as available.” To the fullest extent permitted by law, Pulse disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, security, and reliability.

Pulse does not guarantee:

  1. That markets will be accurate, fair, or correctly resolved.
  2. That users will behave honestly or lawfully.
  3. That content will be available or preserved.
  4. That virtual credits will be maintained or error-free.
  5. That the Service will be uninterrupted, secure, or free of bugs.
  6. That Pulse is suitable for any specific purpose.

You use Pulse at your own risk.

23. Limitation of Liability

To the fullest extent permitted by law, Pulse and its owners, officers, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, service interruption, device issues, content loss, market disputes, credit adjustments, or user conduct.

To the fullest extent permitted by law, Pulse’s total liability for any claim related to the Service will not exceed the greater of:

  1. The amount you paid to Pulse in the 3 months before the claim, or
  2. $100.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

24. Indemnity

You agree to defend, indemnify, and hold harmless Pulse, Atlas Studios LLC, and their owners, officers, employees, contractors, agents, affiliates, and service providers from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from:

  1. Your use of Pulse.
  2. Your content.
  3. Your markets or groups.
  4. Your violation of these Terms.
  5. Your violation of law.
  6. Your violation of another person’s rights.
  7. Your use of Pulse for real-money wagering, off-platform payouts, or prohibited activity.

25. Dispute Resolution

Before filing a formal claim, you agree to contact us at [support email] and attempt to resolve the dispute informally. We will try to resolve the dispute in good faith.

If a dispute cannot be resolved informally, disputes will be resolved in the state or federal courts located in North Carolina, unless applicable law requires otherwise.

You and Pulse agree to bring claims only on an individual basis and not as part of a class, collective, consolidated, or representative action, to the fullest extent permitted by law.

26. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles, except where applicable law requires otherwise.
